The Terms and Conditions of The Capital Coffee Promotional Programs (“Promotions Terms”) set out the general principles applicable to promotional programs, offers, vouchers, promo codes and marketing-promotion activities organized by The Capital Coffee.
Each specific promotional program (“Program”) may have its own rules and conditions. Customers should read these Promotions Terms together with the information and rules of the specific Program before participating.
1. Scope of application
These Promotions Terms apply to Programs organized and announced by The Capital Coffee on its official channels.
Programs may be implemented on The Capital Coffee website, Web Retail, Drink Ordering, eligible Experience Locations/POS, the official The Capital Coffee application when released, or other channels announced by The Capital Coffee.
A Program is not automatically applicable across all channels, locations or products of The Capital Coffee.
2. Rules of each Program
Each Program may specify its name; the form of promotion; the time and geographic scope of application; eligible participants; the goods or services covered; the value or content of benefits; the conditions for receiving benefits; any quantity limits or other caps; the channels and locations where it applies; whether it may be combined with other Programs or benefits; and other lawful conditions.
Specific information will be published to customers before or at the time of participation in the Program in accordance with applicable provisions.
3. Forms of promotion
Depending on the Program and within the limits permitted by law, The Capital Coffee may implement forms such as discounts; free goods or services; purchases with added benefits; vouchers or promo codes; combos; time‑limited offers; shipping‑fee support; offers for Members; offers by membership tier; awarding or multiplying Membership Points; or other lawful marketing-promotion forms.
Technical support for a promotion format does not mean that the promotion is active.
4. Compliance with promotion laws
The Capital Coffee implements each Program in accordance with Vietnamese laws on commerce, marketing promotion, consumer protection and related regulations.
Before activating a Program, The Capital Coffee will fulfil the legal obligations applicable to that Program, including publishing required information and, when required by law, notifying, registering, obtaining confirmation, reporting, or performing corresponding procedures with the competent state authority.
The form of promotion, discount rate, value of goods or services used for promotion, the determination and granting of benefits and other limits of each Program must comply with the laws applicable at the time of implementation.
5. Participation conditions
Customers must meet the conditions published for the Program at the time of the transaction. Conditions may relate to products, transaction value, time, location, sales channel, quantity, payment method, membership status or other lawful criteria.
The Capital Coffee will not impose additional adverse conditions on customers after a transaction has met the published conditions, except to address errors, fraud or as required by law.
6. Term of application
Each Program has a specific start and end time announced. Benefits arise only where the transaction meets the conditions during the Program validity period.
Adding products to the cart before the Program ends does not automatically secure benefits if the transaction has not reached eligible status before the end time, unless the Program rules state otherwise.
7. Applicable products and services
A Program may apply to all or part of the products, services, categories or specific items. Excluded products or services must be identified or be identifiable from the Program information.
Products outside the scope of the Program are not eligible for benefits merely because they are purchased in the same transaction as eligible items.
8. Channels and locations of application
A Program may apply on one or more specific channels or locations. An offer appearing on one channel is not automatically applicable on another channel.
If a Program applies only at certain Experience Locations or in particular areas, that scope will be announced in the Program information.
9. Value of the offer
The value of each Program's offer is announced in the corresponding form, such as discount rate, amount reduced, goods or services given, combo benefits or other benefits.
If there is a maximum discount per transaction or per customer, that limit must be published in the Program conditions. The actual benefit will not exceed the limits prescribed by applicable law.
10. Minimum transaction value
A Program may require a minimum transaction value. Program information must specify or allow customers to determine how the eligible value is calculated.
Items not counted toward the eligible value, if any, will be disclosed appropriately.
11. Quantity and benefit limits
A Program may have a limit on the total number of benefits or the number of uses per customer if such limits are published.
If a Program is announced with a limited number of benefits, the benefits may end when the published quantity has been used up in accordance with the Program rules.
The Capital Coffee will not rely on “out of benefits” to refuse a benefit if the corresponding limit was not published or there is no appropriate basis for verification.
12. Vouchers and promo codes
Vouchers or promo codes may have their own validity period, value, transaction conditions, applicable products, channels, locations, target audience and number of uses. Vouchers or promo codes may only be used within the scope of the published conditions.
Vouchers are not redeemable for cash, unless the Program rules or applicable law provide otherwise.
13. Purchase-with-gift Programs
For Programs that require purchase of certain products or quantities to receive products, services or other benefits, the conditions for receiving those benefits must be clearly published.
Gifts are not exchangeable for cash or other products unless the Program expressly allows it or the law provides otherwise.
14. Combos and promotional bundles
Combo or bundle offers apply only when the transaction satisfies all published components and conditions.
Cancellation, exchange or refund of a component may lead to recalculation of the transaction's benefits if consistent with the Program rules and the applicable return policy.
15. Time-based offers
Programs may apply during specific hours, days or time periods. The transaction time as confirmed by the system according to the Program conditions is the basis for determining benefits.
The applicable time window must be clearly published.
16. Shipping fee offers
Programs that support or waive shipping fees may depend on area, order value, delivery method, maximum support level or other conditions that are published.
If the actual shipping fee exceeds the published support level, the customer pays the difference.
17. Programs for Members
A Program may apply to all customers, be reserved for Members only, or be reserved for certain membership tiers.
Membership status and membership tiers are determined under the Terms of The Capital Coffee Membership Program and the membership conditions currently published.
18. Membership Points in Promotional Programs
Programs may award additional or multiplied Membership Points for eligible transactions. Points arising from Programs remain subject to adjustment under the Terms of The Capital Coffee Membership Program.
Membership Points are not automatically convertible to cash.
19. Concurrent use of multiple offers
The ability to use a Program concurrently with vouchers, Points, Member benefits or other Programs is determined by the conditions published.
If an offer is not combinable, the Program information must state this clearly. When a customer has multiple eligible offers but cannot use them simultaneously, the system may apply an established selection rule and display the actual benefit before the customer confirms the transaction.
20. Display and confirmation of benefits
The Capital Coffee strives to ensure promotional information is displayed accurately and consistently. Actual benefits are confirmed at the appropriate step before the customer completes the transaction.
Banners, promotional images or abbreviated messages must be read together with the Program rules and conditions. No promotional content should be interpreted in a way that omits information the law requires to be provided to customers.
21. Display or information errors
If there is a clear error in display, price, benefits or conditions due to technical or data errors, The Capital Coffee will review the matter based on the published Program information, transaction data and applicable law.
Error handling must not be used to unilaterally remove a customer's validly accrued benefit in contravention of the law.
22. Payment
A Program may apply to one or more specific payment methods if such conditions are published. Failed, canceled or incomplete payment transactions may not generate benefits.
Payment continues to be governed by The Capital Coffee's Payment Policy.
23. Transaction cancellation, returns and refunds
When a transaction is canceled, returned or refunded in whole or in part, related promotional benefits may be recalculated proportionately to the part of the transaction that remains valid.
Vouchers, gifts, discounts or Points arising from the canceled or refunded portion of the transaction may be adjusted if consistent with the Program conditions.
Such handling does not limit the customer's statutory rights to return, refund, complain or other rights under the law.
24. Fraud and abuse
Customers must not create fake transactions, misuse another person's account, create multiple accounts to bypass limits, exploit technical errors, manipulate transactions, vouchers or cancellations/refunds to obtain benefits contrary to the Program conditions.
When there are reasonable signs of irregularity, The Capital Coffee may temporarily withhold benefits for the time necessary to verify. Denial or recovery of benefits will only be carried out where there are appropriate grounds and the customer has the right to request review of the related decision.
25. Technical incidents
In case of service interruptions, system errors or technical incidents affecting a Program, The Capital Coffee may take reasonable measures to verify and remedy the situation.
Handling will be based on verifiable transaction data, the published Program conditions and the customer's lawful rights. A technical incident does not automatically permit The Capital Coffee to remove validly arisen benefits.
26. Personal data
Personal data processed during participation in a Program is handled in accordance with The Capital Coffee's Privacy Policy, Personal Data Protection Policy and applicable law.
Data will only be processed in line with the identified and notified processing purposes, and to the extent necessary to determine participation conditions, grant and manage benefits, prevent fraud, ensure system security, support customers, reconcile transactions and fulfil legal obligations.
Participation in a Program does not automatically imply consent to receive marketing or advertising. Processing data for advertising, marketing or other purposes requiring separate consent must comply with consent requirements and data-subject rights under the law.
27. Consumer protection
The Capital Coffee provides Program information clearly, accessibly and consistently with the transaction format.
No clause in these Promotions Terms or in Program rules is intended to exclude or limit the mandatory rights of consumers.
In case of multiple interpretations of content applicable to consumers, interpretation is made in accordance with consumer protection law.
28. Program changes
The Capital Coffee may change a Program when necessary for business, operational, security or legal reasons.
Changes affecting customer benefits will be announced in an appropriate manner before application where required by law or by the nature of the change.
The Capital Coffee will not apply changes retroactively to unilaterally remove benefits that have validly arisen for customers, except as provided by law.
29. Suspension or termination of Programs
The Capital Coffee may suspend or terminate a Program in accordance with published conditions and applicable law.
If suspension or termination affects benefits that have already arisen, The Capital Coffee will implement handling measures consistent with the Program conditions and the law.
30. Complaints and reconciliation
Customers have the right to request review of transactions or promotional benefits. The Capital Coffee may request necessary information to verify the transaction and the requester.
Receipt and handling of complaints are carried out in accordance with The Capital Coffee's Complaint Resolution Policy and consumer protection law.
31. Responsibilities of The Capital Coffee
The Capital Coffee is responsible for organizing Programs according to the published information and conditions, fulfilling related legal obligations and handling customer benefits in accordance with the actual transaction.
Nothing in these Terms excludes The Capital Coffee's mandatory liability under the law.
32. Responsibilities of customers
Customers are responsible for providing accurate information when necessary, reading Program conditions, protecting their account/vouchers/promo codes and not committing fraud or abuse.
These responsibilities do not remove or limit customers' rights as consumers.
33. Relationship with the Membership Program
The Membership Program and Promotional Programs are two separate commercial programs. Customers may enjoy Membership benefits and promotional benefits simultaneously when the respective conditions permit.
Points, tiers and Membership benefits are governed by the Terms of The Capital Coffee Membership Program.
34. Amendment of the Promotions Terms
The Capital Coffee may update these Terms to reflect changes in law, business operations or systems. The version and effective date of updates will be published on the appropriate official channel.
Amendments to these general Terms do not automatically alter retroactively benefits that have validly arisen under prior Programs.
35. Governing law and dispute resolution
These Promotions Terms and the Programs are governed by the laws of Vietnam.
In case of disputes, customers and The Capital Coffee are encouraged to first communicate via the official support channels. This does not limit the right to complain, negotiate, mediate, request competent authorities, arbitration or initiate legal proceedings as provided by law.
36. Contact information
Questions, support requests or complaints related to a Program are received through The Capital Coffee's official contact channels published on the website and the The Capital Coffee application when released.
Company information and legal contact information are published in The Capital Coffee's Legal Center.
37. Related policies
These Promotions Terms are read together with the General Terms of Transaction; Terms of The Capital Coffee Membership Program; Privacy Policy; Personal Data Protection Policy; Payment Policy; Shipping Policy; Returns Policy; Complaint Resolution Policy and other specialized policies as applicable.
Where a specialized policy provides more specific provisions on a matter within its scope, the specialized policy applies to that matter but does not limit the mandatory rights of consumers.
